Partner of a Dutch residence permit holder 
Family reunification application – IND Netherlands

This procedure is meant for family members above the age of 18 years old, who wish to stay with their family member in the Netherlands.   
The legal status of the family member in the Netherlands will decide which application procedure is appropriate. If you are a family member of an EU-citizen or his/her partner, then take a look at our family member of an EU-citizen page or partner of an EU-citizen page.  
Are you a family member of a Dutch residence permit holder? Then take a look at our family member of a Dutch residence permit holder or partner of a Dutch residence permit holder page.  
 
Are you the partner of a person with the Dutch nationality and the verification against EU law doesn’t apply? Then take a look at our partner of a Dutch citizen page. If you are a family member who is not a partner of the Dutch citizen, then an application based on art.8 of the EVRM Treaty applies to your situation.

Are you a family member who is above 18 years old (non-partner) of a non-Dutch and non-EU citizen who has a Dutch residence permit? In that case you also fall under art. 8 of the EVRM Treaty.  

  • The entrepreneur must have the American nationality;
  • The entrepreneur has to invest a certain investment amount in the company that he/ she is going to establish in the Netherlands. The following investment amounts apply;
    – If the entrepreneur is going to establish an ”Eenmanszaak”/ one man business, an amount investment amount of €4500 applies; 
    – If the entrepreneur is going to establish a ”Vennootschap onder firma/ general partnership, a minimum investment of 25% of the paid- in capital applies, with a minimum of €4500; 
    -If the entrepreneur is going to establish a ”Besloten vennootschap”/ a private limited company, a minimum investment of 25% of the paid- in capital applies, with a minimum of €4500; 
    – If the entrepreneur is going to establish a ”Naamloze vennootschap”/ a public limited company, a minimum investment of 25% of the paid- in capital applies. The paid- in capital for a public limited company is at least €45.000, which means that the minimum investing amount has to be €11.250.

This depends on the validity of the permit of your family member which whom you are going to stay. In that case, the validity is the permit is the same as that of your family member who has a residence permit. Is your family member Dutch or an EU-citizen? Then the family reunification residence permit, will be issued for 5 years.

If you are a family member (non-partner) above 18 years old who wish to stay with a Dutch person or Dutch residence permit holder, it’s important that you are fully dependant on your family member who is Dutch or has a Dutch residence permit. It’s important that you will be able to prove that with supporting documents.  

The family members that fall under the art. 8 EVRM procedure are usually parents or children, or other family members who are above 18 years old.
