EU blue card visa application – Netherlands

The EU blue card visa procedure is meant for companies who wish to hire a non-EU highly skilled employee. An advantage that the EU- blue card visa procedure has over the highly skilled migrant procedure is that the employer/ company doesn’t have to be recognized by the IND as a sponsor. This procedure is a huge opportunity for companies who are not recognized by the IND as a sponsor and/or not eligible for the recognized sponsorship status at the IND. The EU blue card visa is a huge oppurtunity for start-up companies who can now avoid a procedure of six months to gain the sponsorship recognition status at the IND. The EU blue card visa is a great opportunity for startups and small companies who wish to avoid the 6 months procedure of becoming a recognized sponsor by the IND. 

The EU blue card visa procedure is an additional path for companies who wish to relocate a non-EU highly skilled migrant (expats) to The Netherlands. Unlike the highly skilled migrant visa application, the EU blue card visa application enables companies to relocate their workers to The Netherlands without being a recognized sponsor by the IND. 

The EU-blue card visa holder/ employee has to fulfill the following criteria: 

  • The EU blue card visa holder has to be highly educated. He/ she has to have – according to Dutch standards – completed at least a study from a university of applied sciences (HBO). It also had to be a study with a duration of at least three years or;
  • The EU blue card visa holder has to have at least 5 years of work experience, prior to submitting the EU blue card visa application at the IND. 
  • Is the EU blue card visa holder an IT manager or an IT professional? In this case the EU blue card visa holder has to have at least 3 years of experience in the last 7 years, prior to submitting the EU blue card visa application at the IND.
  • The EU blue card visa holder has to meet the gross monthly salary criterium of €5331. 

The company/ employer has to meet the following criterium: 

  • In the 5 years prior to the application, the employer may not have been sanctioned for violation of Article 2 of the Foreign Nationals Employment Act (Wav). Or a sanction because no or insufficient wage taxes or employee and national insurance contributions has been paid by the employer.

Most frequent questions about EU blue card visa application

Every EU blue card visa holder who is residing in the country of origin needs an mvv, except for citizens of the United States of America, Canada, Australia, New Zealand, Japan and South Korea.  The MVV procedure is indeed included within the EU blue card visa procedure.

The EU blue card visa procedure usually takes no longer than five weeks for non-recognized companies. For recognized sponsors, the procedure usually takes up to two weeks. Keep in mind that the IND has a legal term of 3 months to issue a decision.

If the EU blue card visa holder has a foreign degree and diploma, then the diploma has to be evaluated by the Nuffic. INLS will manage this process as well.

As an employer you must oversee that the salary is always guaranteed and paid to the EU blue card visa holder. You’re also responsible that the EU blue card visa holder always works within the company. If the EU blue card visa holder resigns from the job, you as an employer need to notify us immediately so we can start the deregistration process.   

The costs for the de-registration procedure are €175 exclusive of the VAT costs.   

The IND fees are €380. Citizens from Israel and San Marino are exempted from paying the fees for their first application for an MVV.   

The EU blue card visa is valid for a maximum of four years, in the case of an indefinite contract or a contract of four years.
